Dear friends,

I'm new to this site and have found some very interesting threads. I have an urgent request related to PF, and your direct replies would be appreciated. I've tried locating the information in this forum but could not find it.

The problem...

Because of family reasons, I am resigning from my current job and would only start looking for a new one sometime next year. I would like to withdraw my PF during the period. I know that you are required to submit a form along with an affidavit confirming that you have been without a job after a period of 60 days from the date of relieving of service.

Please confirm the following:

a) Is the last employer required to sign the required form? (From my understanding, there is no requirement as the PF is mine, and they have absolutely no say in the withdrawal after a relieving of duties.)

b) Are there any other formalities that need to be completed?

Hi ACY,

If the last employer can sign, then there won't be many problems. Otherwise, you should get it signed by a government officer, MLA, or MP. Even the PF commissioner can sign on behalf. Moreover, you should know other details like your contribution and PF number.

Alternatively, you can wait until you get another job and then transfer the same.

Hello Jeeva,

Many thanks for your quick response. I need to withdraw the PF, and I have all the relevant details. What is the logic behind anybody else required to sign the form? The PF department needs confirmation that I am not working anywhere, and this is satisfied by the affidavit. The previous employer can only confirm that I'm no longer in service with them. This can be confirmed by two things:
a) There is a relieving letter.
b) There are no further additions to the account after a given date. This is verifiable by the PF Authority themselves.

Firstly, could you please tell me your name?

As per PF department rules, it clearly states that either the employer or any gazetted officer must sign the document. Alternatively, you can consult the PF commissioner directly. Since he holds the same rank, he may assist you in this matter.

We cannot question the logic behind the rules; they are to be followed as they are stated.

Do you know the monthly contributions from both yourself and your employer for the specific period (as per Form 3A)? Additionally, these details for the last financial year must also be provided. If you are aware of these details, kindly complete the form and meet with the commissioner.

Employees do not require a relieving letter. Once an employee leaves the organization, the employer will update the necessary documents with the PF department, which is considered sufficient.

I may not be in the position to ask you this question, but I apologize for inquiring. Could you please inform me if there are any issues with the employer signing the PF forms? Moreover, as you have received your relieving and other documents, why are they hesitant to certify the PF forms? It is their responsibility to certify the forms, and you have the right to request it.

Dear Friend,

If employment is ongoing, only the employer is eligible to sign the forms. If the employer refuses, you will need to visit the PF commissioner. The commissioner will then forward your case to the concerned Enforcement Officer. Subsequently, your PF process will be under the consideration of the Enforcement Officer.

Dear ACY,

All you need to do is to fill up Form No. 19 and 10C, and get it endorsed by your current employer. Submit the same with the concerned PF Office and obtain a receipt for it. The receipt is very important since you may have to follow up with the PF authorities for your settlement. This will come in very handy at that time.

Of course, you will be entitled to submit your application for withdrawal only after 60 days of leaving your present employment.
