Dear All,

Could anyone please let me know, as per the laws, how many total days of leave an employee is entitled to in terms of:

- Total leaves in a year
- Casual leaves
- Sick leaves
- Privilege leaves

Also, if the employee is a consultant, how many leaves would they be entitled to?

Asmita

There are 2 sets of employees in a manufacturing setup. The leave entitlements are as follows:

1. Workers: The employee is entitled to one leave for each 20 days worked as per the India Factories Act, i.e., Casual Leave as per the provisions of Standing Orders and Sick Leave at the discretion of the management. Normally, it can be 8-10 days of Casual leave and 7-8 days of sick leave. Please note this is in addition to PL. The PL is carried forward to the next year. In some organizations, some portion of unavailed CL and SL is converted into PL, but this is as per company policy.

2. Staff: The employee gets 30 Privileged leaves in a year if intervening W/O and Holidays during leave availed are counted as leave. If intervening W/O and Paid holiday during leave availed are not counted as leave, 26 or 24 days of EL are allowed. In some companies where there are 5 working days, the leave is allowed for 21 days. Additionally, 07 casual leave or 10 leave is allocated (Refer Standing Orders Act). Sick leave is at the discretion of the management.

Apart from these leaves, the employee gets public holidays and national holidays up to 6-10 days as per company policy.

Consultants are generally on contract, and the leaves will be as per the terms of the contract. The employee is entitled to one leave for each 20 days worked.

Dear Asmita,

According to "The Factory Act 1948," we have to provide 1 full day leave on each 20 working days to all the employees. So, as per the law, the total number of PL will be 15 in a calendar year.

Regarding the Casual leave, it depends upon the provisions of certified standing order of the company. Generally, it can be 7-8 in a calendar year.

Regarding the SL, it depends upon the discretion of the management.

Dear Asmita,

Casual leave varies from state to state. For example, in the Model Standing Orders applicable in Tamil Nadu, it is 10 days with pay, whereas in some states, it is 10 days with or without pay. Sick leave is as per company policy. If the factory is covered under ESI, then we need not provide sick leave.

Ponnu

Hi Shubhankar,

You mentioned the "leave law." According to the law, an employee is entitled to 1 full day of leave for every 20 days of work. Therefore, the maximum total of leave days in a year would be 15, not 30 as you stated. Please verify this information, and if you have any updates, kindly provide them with a reference.

Hi Asmita,

In the current BPO culture, the average number of leaves given to employees is 24 per annum. The distribution of these 24 leaves completely depends on your company's policies. You can choose to keep all these as a set or distribute them into CL, SL, and PL.

If you decide to distribute them, at least 50% of your leaves should be casual. So, your leave count would be:
CL - 12
SL - 6
PL - 6

Alternatively, you can opt for two sets, consisting of 12 CLs and 12 SLs, with only the SLs eligible for carry forward to the following year.

Dear All,

Is there any reference material on leave for different industries? Like we all know that manufacturing industries have to compulsorily follow guidelines. But what about other industries? Do they have to go as per law or can they follow their own?

Asha
