Sir, We are a small scale industries (Telecom & IT based industry) planning to shift our factory from Delhi to Rudrapur (Uttrakhand), where we have taken factory licence since we are left with corporate office only in Delhi, do we need to have the following licences at Delhi address. If yes please explain
1. Under Factories Act (Factory Licence)
2. Municipal Corporation Licence
3. SSI (Small scale Industries)
Kindly advise if we need to surrender our existing licences here & keep our corporate office under the shops & establishment act, subsequently, our factory in Rudrapur (Uttrakhand) shall be governed by these acts. Kindly advise.

Dear Deepak,

You need to first surrender all your existing original consents with the appropriate covering letter to all concerned state/central government agencies/departments. Typically, in a winding-up operation, you need to do the following:

a. Surrender the existing Factory License (DISH). Please ensure you attach all the last filed returns along with it. Also, attach the last medical test report card from doctors approved by DISH, crane test reports, etc. Please prepare a nice cover letter covering all the points from your industrial aspects related to DISH with enclosures. Take acknowledged copies of the letter, and if DISH in your state issues a confirmation of cancellation/surrender of the license, do take it.

b. State Pollution Control board certificate surrender. Attach the last Hazardous Waste Statement, Annual Environment Return Statement, Water CESS Payment receipt. Also, attach the original consent with the appropriate cover letter covering various aspects as per your consent.

By transferring your unit from Delhi to Rudrapur, the following procedures are applicable in your case:

1. In Rudrapur, you have to obtain a Factory License from the Director of Industrial Safety & Health, Government of Uttarakhand if you are hiring more than 10 employees and running your factory with the aid of power.

2. Since your office is located in the Delhi area, you are required to comply continuously with The Shops & Establishment Act issued by the NCT of Delhi.

3. The Factory license you have obtained from DISH Delhi Government, you have to surrender your license as per the provisions of the Delhi Factory Rules in conjunction with The Factory Act 1948.

We are a small-scale manufacturing industry planning to shift our factory from Hebbal Musore to Koorgalli Mysore. We have a factory license for Hebbal Musore, but now our corporate office is the only entity remaining there. Do we need to fill out a surrender form for the following licenses?

1. Under Factories Act (Factory Licence)

Kindly advise if we need to surrender our existing licenses here and maintain our corporate office under the Shops and Establishment Act. Subsequently, our factory will be in Koorgalli Mysore.
