Hi,

This is regarding Bombay Shop & Establishment Act.

As per my knowledge there is no principal difference in application of act in Mumbai or Maharashtra.

. For the jurisdiction of Greater Mumbai by virtue of the statutory provisions of Section 43 of the said Act subject to the overall supervisions of the State Government through the Commissioner of Labour, Mumbai. The shops & Establishments Department is headed by the Chief Inspector, Shops & Estts. the Chief Inspector, Shops & Establishments is assisted by Deputy Chief Inspectors.

The prescribed fee for registration and renewal etc. may differ from other part of the state as per notification of state govt.

•Generally the following Registers/ records/ notices etc. are to be kept by the different categories Register of Employment

*A Muster-Roll – Cum-Wage Register as laid down under Rule 27(1) of Maharashtra Minimum Wages Rules 1963

*Visit Book ( Rule 20 (13)

*Name board in Marathi (Rule 20-A)

*Display of abstract (Rule 20(7)

*Display of Reg. Certificate Sec 7(2)

•Notify to the Sr. Inspector (Shops & Establishments) at the beginning of the every calendar year regarding list of closed day of the respective year

etc.

In addition to Bombay Shop & Estt. Act, the authority under the act also empowered to enforce the provisions of the following acts and rules framed there under

• The Minimum Wages Act, 1948.

• The Payment of Wages Act. 1936.

• The Workmen’s Compensation Act, 1923.

• The Industrial Employment (Standing Orders) Act, 1946.

• The Maternity Benefit Act, 1961.

• The Child Labour (Prohibition and Regulation) Act, 1986.

So alongwith BSE Act ,you will have to maintain other registers as prescribed under the various act as and if applicable.
