Sir, in ESI Act, 1948 and rules/regulations framed thereunder there are two type of benefits i.e. firstly benefit in kind/in the form of medical services, which is available from ESI dispensary and hospital etc. As soon as an employee is enrolled under said Act and Insurance Number/Identity Card/TIC is issued, the employee becomes entitled for the same till his benefit period lasts. The second type of benefits are cash benefits, which are in the form of payment of benefits in cash. For payments of various cash benefits, there are various terms and conditions which are required to be fulfilled and complied with. You can download relevant literature on this issue from the website of ESIC.
2. However, entitlement for such benefits and actual availing of said benefits are two different aspects since these benefits are available in certain contingencies viz. sickness, maternity, accident etc. etc.

Sir, I have already mentioned that the entitlement for medical benefit (i.e. treatment) under ESI Act, 1948 and rules/regulations framed thereunder starts immediately as and when TIC/Identity Card is issued to an employee and continues the same till the benefit period in respect of said employee closes. However, in respect of cash benefits, the benefit period starts after expiry of 9 months from the date of employment of said person(see proviso to Regulation 4) and that too if the minimum contributory conditions are fulfilled in respect of said insured person.
