Hi Seniors,
plz guide me... if the employee
worked 6 days in week then the employee is entitled to get one paid weekly off or not as per factory act.
actually the issue is subjected to
calculation of salary... for instance employee salary is 6000 PM, to calculate the salary what formula shall be used weather 6000/26 or 6000/30,

Mostly there is two type of salary calculating formats.
First is monthly
and second is on 26 days.
Calculation in monthly case
(total present+holiday)/30
but in 26 days format calculation is
total present/26.

If particular employee is on roll then that should be on 30 days as per month wise. Onroll employees salary is considered 30 days

Employees are entitled for 1 day off after every day of work. Calculations are to be done on 26 days formula.

sir, you have mention that employee is entitled to get one day leave after working 6 day however if we use formula of 26 days then it won’t be the paid weekly off, your view pls..........

The Factories Act 1948 prescribes a day of rest after a worker is engaged for 6 days. It does not prescribe paid off unlike Shops & Establishment Act. Do not confuse and ask why it is 26 days You calculate for every month normally then at the end of the year you will find them in order as in February you will have lesser days

yes i confused about weather to calculate by 26 or 30 days'
however in this forum some of the seniors has replied differently in this regard.. pls explain me with the rule that should i calculate salary for 26 days or 30 days if for 26 days why anyone pls explain the same,

Factories Act does not say that there should be a "paid weekly off" to workers and for that matter, no law is saying so.
While making wage or salary calculation, many years time ago, there used to a system of dividing salary/wage by the calender days of month. In this method, every month salary rate used to change. In February per day rate was highest. Then, soon people learnt a flaw in the system. They started taking offs in January (lowest rate) and asking for compensatory off in February. (highest rate)
Therefore, that method was discontinued and 30 days of calender was utilised. After some time, Gratuity act was amended and for calculating per day rate, denominater 26 was prescribed, whatever may be your denominator.
Now, what is advisable is division by 26 to Salary/ Wage multiplied by the days present or payable and ignoring all weekly offs of any month. Rate remains uniformal throught...
So dividing by 26 is the best method of calculation of salary..
