Hi all,
We have 3 months paid maternity leaves for all women in our organization but never give any male a paternity leave even when it was applicable. Right now, someone is asking for the same. In our HR policies made in 2009, it says paternity leaves are upto 30 days. I checked some info on Google, but it says paternity leaves are for 15 days only.
Also, is it mandatory that they should take all leaves in one go or they can take some now and remaining later in the financial year as and when required?
Please suggest. Thank you.

Dear Manali,

Paternity leave is different from maternity leave. Latter is under the provisions of Maternity Benefit Act 1961 or ESI Act whereas former comes under employee welfare or fringe benefits. Therefore, there are no fixed rules on the quantum or splitting of paternity leave. You may design your own policy after discussing with your management. You may keep following points in mind while designing the policy:

a) Total number of male employees in the age group of 26-35. This age group will avail of paternity leave most

b) Length of continuous service in the company to become eligible for the paternity leave

c) Duration of leave and how many times it can be split

d) How many times male employee can avail of this leave in span of ____ years.

e) Advance notice requirements to avail of this leave

f) Submission of certificates and other documents withing ____ weeks/months after availing of this leave

g) Who will be responsible to make standby arrangement for the absence caused due to this leave

h) How the application will be routed, who will be final sanctioning authority

i) Other points, if any
