Hi all, Plz let me know is it mandatory to have Factory act./shop & establishment registration to get the registration in EPF & ESIC?

Any organisation which has employed 10 and above employees is mandatory for ESI registration & if 20 and above then its mandatory for EPF registration

Sir,
I know about 10 employed for ESIC and 20 Employed for EPF
Registration.....
My query was to get registration in
EPF & ESI is it mandatory to have
Either registration in factory act.
Or in shop & establishment act.

Its not a mandatory to have FA/S&CE registration.
But these depts are interlinked, they will be to know the information from ESIC or PF dept.
Safer side better to get immediately after the code obtained.

Yes. It is a must. You have to mention the Registration No. and date in the coverage application to get code No. for coverage for PF and ESI.

PF registration can be voluntary also, even in case employees less than 10 or even if an establishment do not fall under category of a Factory/Commercial Establishment / Shop. Unless coming under exempt category or located in a non-esi covereabale area, ESIC registration is a must.

1. Sir, there is no relationship between EPF & MPs Act, 1952, ESI Act, 1948, the Factories Act and the Shop & Commercial Establishment Act(s)( of the concerned States). The scope and coverage in these Acts are independent to each Acts. No comparison can be made except that if coverage is established under these Acts, the compliance is compulsory and non-compliance may result into prosecution of the defaulter principal employer as defined in said Acts. There can be specific exemptions as in case of the Maternity Benefit Act, 1961 and the Employees' Compensation Act relating to some matters/benefits as available under ESI Act, 1948.

2. The person who raised this thread ( anonymous) can go through above Acts and if there is any doubt, he can raise the same based on relevant sections and rules etc. I feel that comparison of different Acts is meaningless and of no use. There are various establishments which are covered or coverable under Shop & Commercial Establishment Act (of concerned State) as well as under ESI Act, 1948 and EPF&MPs Act,1952. Even if a unit is not covered under the Factories Act, it does not mean that the said unit should not be covered under ESI Act, 1948 or under even under EPF & MPs Act, 1948. Each department conduct their surveys or inspections independently and non-coverage by any other department under any Act is not a relevant issue.

all of you has replied differenty therefore i am still in confusion....
my query is our org is coverable in S & E act.
however the org is not registered under S & E act....
pls guide me as our org is not registered under s & E act. inspite being coverable... pls tell me is it must to have registration in S & E act. to get registration in PF & ESI,
