We are into Telecom (Service Providers). Most of our staffs are Trainees of whom we deduct TDS. I would like to go for the standing order. But i don't know how to go about and the procedure and required documents etc.

Standing Orders are mandatory for those having not less than 100 employees. Standng orders are framed following the Industrial Employment Standing Orders Act, 1946. There is a model standing Order given in the Act itself. Draft it accordingly, get it certified, that's all.

I AM ATTACHING 2 MODEL STANDING ORDERS FOR YOUR REFERENCE AND RECORD.

YOU HAVE TO DO THE FOLLOWING

01. MODIFY THE STANDING ORDER WHEREVER YOU WANT AS PER YOUR ORGANISATION POLICY AND RULES.

02. IF YOU ARE HAVING UNION, THEN THE UNION REP HAS TO SIGN OTHERWISE SELECT 3 LOYAL EMPLOYEES LIST.

03. SUBMIT THE DRAFT STANDING ORDER (ONE COPY) TO THE COMMISSION OF LABOUR (CERTIFYING AUTHORITY) OF YOUR REGION

04.HE WILL VERIFY AND CORRECT THE SO AS PER THE GOVERNMENT NORMS

05. GET BACK THE CORRECTED SO AND PREPARE 5 COPIES OF THE SAME AND ALSO 5 COPIES IN LOCAL LANGUAGE.

06. THE CORRECTED/VERIFIED COPY WILL BE SENT TO THE LOCAL LABOUR INSPECTOR AND HE WILL COME FOR INSPECTION. HE WILL CALL THE UNION AND IF NOT ANY UNION HE WILL DISCUSS WITH THE SELECTED EMPLOYEES AND EXPLAIN THE TERMS AND CONDITIONS OF THE STANDING ORDER, AND GOT THEIR CONCORENCE. THEN ALL THE EMPLOYEES HAVE TO SIGN AS A TOKEN OF ACCEPTENCE. A COPY WILL BE DISPLAYED IN THE OFFICIAL NOTICE BOARD.

07. THEN HE WILL SUBMIT HIS REPORT TO THE COMMISSWIONER OF LABOUR

08.AGAIN THE COMMISSIONER OF LABOUR WILL CALL THE MANAGEMENT REP AND UNION REP IF NOT THE SELECTED 3 EMPLOYEES FOR SIGNING

09. IF ANY CORRECTION HAS TO BE MADE BEFORE CERTIFICATION THEN IT WILL BE CORRETED AND OPENION WILL BE ACKNOWLEDGED.

10. THEN IT WILL BE CERTIFIED.

11. THE CERTIFIED COPY OF THE SO HAS TO BE DISPLAYED IN THE NOTICE BOARD

12. ONE COPY HAS TO BE GIVEN TO ALL THE EMPLOYEES FOR THEIR REFERENCE AND RECORD.

THIS IS THE GENERAL PROCEDURE. IT MAY VARRY STATE TO STATE.

Is it mandatory to translate a Standing Order in other language as Hindi for understanding of labour.

Dear Member,
In general the area Certifying Officer may require the Hindi or other language DSO as understood by majority of workmen, version from the employer, if the representatives of the workmen demand so. To know the exact details you may go through your applicable IE (SO) State Rules. In the state of Haryana where The Industrial Employment (Standing Orders) Punjab Rules, 1949 are applicable, the Certifying Officer under Rule 6-C may require Hindi version of DSO if the workmen representatives if so require. Rule 8(2) says that the employer shall cause to be pasted the Hindi/Punjabi version of the Standing Orders so approved along with English Text in the manner prescribed. So plz go through your applicable state Rules.
