I am working in a US based retail Company where the parent company is at USA and one back office at India. At USA we have 12 retail stores. The back office which is at India consists of IT Team, Finance team, CSR and as usual HR.
First I want to inform you that my company is registered under Bonbay Shop & Establishment Act. Hence our office timing is 11a.m to 8.30a.m next morning. Different set of employees have different shifts.
Acc. to Bombay Shop & Establishment Act Women Employees cannot work beyond 9.30p.m (Acc. to Chapter -6, sec-33)
Now my question is "In all BPO's employees are working maximum in night Shift only that includes both Male & Female employees. So in which Act they are registered which allows the female employees work in Night Shift"
Hope my question is clear. I need expert's View.

The Shop Act needs to subscribed to as its a "premise". The defintion of work hours whihc is diiferent, can be mentioned in your application. Shop Act Licnese helps in many other areas such as opneing Bank AC or follwoing various stautory obligations. Incidentally, it is called as Shop but need not interpreted as Shop, work hours have to be qualified separately for YOUR Back office. It is still a commercial establishment. You are covered under Shop Act.

Dear Ms Das,
BPOS's are exempted from certain provisions of the Labour Laws applicable to other organizations and entities. Therefore you find women working in night shifts. Each state in India where BPO's exist have the exemptions under the prevalent labour laws to allow women to work at night.

Dear all,
I think BPOs are allowed to employ women at night shifts only on if they make provision for travelling to and from the work place. If an organization does that, then and then only women can be employed for night shift.
Please correct me if I am wrong.

Every BPO will provide Pick & drop facility to their employees working at night. But this is not the eligibility for employing women employees at night.
Hello Swapna we cannot ask this from Shop & establishment dept for it will be just sending invitation to them & they will put penalty on us for employing women employees. If you can speak indirectly & let me know. I will be thankful to u.
My previous company was also registered under shop & establishment act. they used to maintain two registers one showing only 10 employees & the second with real figures. Whenever any inspector used to visit the company they used to replace the registers & lot mre things which i dont want to write.
In this company we want to follow all the rules & regulations as its an MNC & atleast i want to justify my work . Hence I wont allow any sort of fraud in registration or other things. Kindly help in this regard.
