Hi i am from chennai and am writing on behalf of my brother who is currently working in abroad. He was working in Bangalore as a contractor to a reputed Software company for 2 years and he has quit on october 2010.

His resignation was accepted by the HR with the 30days notice period. The issue is they did not recruit a back up for my brother at his notice period. Since he needs to join the new company he has come out of the company.My brother spoke to them lot of times about his relieving letter but there is no proper response. He has sent e-mails to the HR and also the manager of the consultancy who is creating a problem in giving his relieving letter. When we called and checked he says exit formalities needs to be done and speaks very rude.

Can you please suggest what can be done now? Since reliving letter is mandatory for my brother's new company in abroad. Can i do the formalities on behalf of the brother with a signed letter from him?

Please help as this is urgent and am writing this for my brother's best carreer.

Hope your brother might have been given the resignatiion acceptance letter. Please let him send an e mail to the concerned HR under copy to you informing that his sister will complete all exit formalities as required by them. Please note that in such issues, good relations and persuation only will work out. Since the relieving letter is required urgently, please handle the issue delicately in smooth way. If you proceed legally, you will rather land in difficulties.

Hi Sir,
Thank you for your reply. Do i need to inform the HR and the manager of that Consultancy that i am coming to get the letter. My brother sent an e-mail yesterday as per your advise, but there is no reply from them yet. Please suggest.
The consultancy is based in Bangalore.

Hello aishshree,
Can you pl clarify a few aspects of your brother's case?
1] You mentioned that he was working in a Software Company. Then where is this Consultancy coming into the picture? If he was on the rolls of the Consultancy, then pl checkout his Appointment Letter--does the HR of the Software Company come into picture if he resigns?
2] Is he abroad now from the Consultancy or Software Company? If not, on whose rolls is he now?
kanna.vijayakumar is right in that going legal could only complicate the case.
However, I am not sure if you will be allowed to complete the Exit formalities on your brother's behalf. Maybe your brother can sign, scan the necessary documents & mail them to the concerned officials. That should be acceptable.
Even though you are in Chennai, maybe it's better to go to B'lore & meet them once F2F. That would be better than telecons or mails. There's also another possibility--the reason you mentioned [that they didn't hire a replacement so far] could only be an alibi. The real reason could be different--only a F2F will help you to check this aspect out.

a) The software company is not related to any of my brother's actions since he was under the payroll of the consultancy and even in the appointment letter it says only 30 days notice period.
b) Now the replacement is appointed already and he is in service since 2months now.
c) My brother is entirely working for different company now in abroad and a direct employee for the new company.

Hello aishshree,
When he is already working with the new overseas Company, why is the issue of Relieving Letter coming up now?
Also, you mentioned that the Consultancy accepted his Resignation, subject to the Notice period--I assume he served for the FULL Notice Period. Suggest him to show the Acceptance to the new Company--many companies in the IT sector accept it.
Also, ask him to talk to the concerned person--whoever he was in touch with [or working with] in Company where he was working earlier & explain the situation. usually since Consultancies are dependent on the Companies for business, they can't say NO when there's pressure from them--especially when it's for legitimate & ethical reasons.

Yes, my brother has submitted the resignation acceptance, but they need relieving letter as per their company procedure.
Yes my brother did service 30 days notice and the consultancy states he did not do exit formalities.
As u advised earlier am going f2f and know the situation.
My brother was in touch with concerned HR who acccepted the resignation and also he sent reminder e-mails asking for updates but there is no positive reply.
Today am going bangalore for f2f. Thank you for the help and hoping a positive reply from them.

All the Best.
I suggest you meet the Consultancy AND also the concerned person(s) in the Company--Project Managers, etc--where he was posted for the work by the consultancy. If you don't know, take the names from your brother.

Dear all,
I am new to HR cite. i have recently left an organisation they have given me service certificate in place of Experience letter and relieving letter. and HR said this works in place of relieving letter,
i was working as Executive design engineer (3.5 year total experience).
attached image of experience letter. (masked some portion for safety)
my question:
1) what is difference between service certificate and experience letter, which one is good for m post.?
2)will this service certificate works in place of relieving letter .(my new company may require relieving letter)?
3) please look at format of experience letter attached, there are no sentences , will this create any impact on my future company where i will join?
please this is an urgent post reply as soon as possible.
