Hi,

Am Nandita,I was working in a finnace firm for 2 yrs which I quit 3weeks back.I got an offer from a bank which I took up.But this job was under contract(third party rolls) as my previous job.
Now the issue is that since the 2 weeks I have joined,I have realized the work environment is not at all conducive to work in.No support from employees,too much work to even have the time to have lunch,and a boss who is very abusive.
Due to some technical reasons from my HR dept,the contract letter has not yet been handed over to me to be signed.Since the requirement was urgent,the copy- short version was emailed to me.Hard copy was to follow later.I just cannot adjust,its affecting my health coz of long hours and stress.

Meanwhile I have got another offer from a reputed co which is on rolls of the Co.

I have the following questions-

1)Since I have not yet signed the contract,am I supposed to give a notice period.As per the contract,it says 1 mth notice.What is it in this case?

2)Also am I eligible to get my two weeks salary?(in the two weeks I have really given my sweat & blood)

Please reply,ur insights are valuable.

1. The good thing is that you have not signed the contract and verbal communication doesn't matter.
2. And second you are liable to get 2 weeks salary. So I believe it is not an issue.
You can tell them due to health prob. or something else M leaving the company. No company in India will force until unless they are bonded with agreement. As per your above statement I believe the company is not having a fertile environment or well cultured.

DO not afraid of any misconceptions about HR or Personnel management that you are bonded labour and cannot join another organization without relieving letter or any other reason.
All employees who are not satisfied with employers work culture and enviornment which is abuseive irrespective of contract signed or not whether on probation or permanent or temporary status of employment you have liberty to leave any company anytime you wish.

Irrespective of contract signed or not??????? Strong statement - care to relook at this once again. You cannot refute a signed legal agreement.

hi Nandita,
As you have not signed contract therefore one can not force you to comply some thing on that basis. If you have done joining formalities and have some proof of your working there compnay must have to pay your salary.

Well Nandita, if you haven't signed the contract then there is no need to give the said notice period. However, you will contradict this fact of contract not signed if you ask for salary for whatever 2 weeks you have served.
Thus, you need to decide whether u want to leave immediately without asking for 2 weeks salary or whether you want to leave after giving notice period with salary paid for the days you have worked.

Dear Nandhita
I feel very sad for things happening for you. As per my knowledge you can resign the job and accept the new co (with co pay roll), since you have not signed any contract there is no issue.
After resignation be firm with them and collect the 2 weeks salary. If your current employer rejects, then will see the posibility.

Gentleman,
Labour is freemarket he can opt to resign and leave the organization even though he has signed any contract or agreement. This employment contract or agreements has limited liability of notice period whether expressed or not in agreement but it cannot violate Labour Laws.
Employee is commodity andhe cannot be treated as bonded labour for same terms and conditions if he has better offer of employment.
Please go through Labour Law Journal and other Case laws where in Supreme Court has given land mark judgements on this issues.

Look nadita since u have not signed the contract it is not mendetory for u to give any notice period.Don't be so worrid kuch nahi hota hai yaar. just chill.don't worry about the salary it will come automaticaly if u have given ur account number to HR people.
