I am working with a Pvt Ltd. company for the last 3-1/2 years. My family is residing in my hometown only. Now I am getting a new job in the same profile with good salary hike and the new organization in ready to give me my hometown location. I have resigned from my current organization, but right now the resignation is not accepted. As per my appointment letter I have to serve 3 months of resignation period, but if I want early relieving I have to pay the salary back to the organization. Now I want early relieving, but as per HR they want Regional Head approval on mail for early relieving, which Regional Head is not ready to give me. I am ready to pay the salary in lieu of early relieving.
Kindly suggest is there any law or legal action that can be taken for my early relieving from the organization.

If the clauses of the appointment letter agreeing the payment of 3 months salary in lieu of the notice period, you have every right to leave the orgnisation by paying 3 months pay.
First write a letter in which state your readiness to pay the salary and get it registered at your office and wait for their reply, till they are adamant in your relieving send a lawyer notice to them.
