If the boss has not paid the salary for the month of January until the fifteenth of February, and the employee resigns on February 16th, is he eligible to receive the salary for the month of January, considering that a 30-day notice is mandatory?

Yes, you can get 15 days' salary by negotiating your 30 days as a notice period and leave the company immediately if the company is ready to relieve you.

Alternatively, you are eligible to get your January salary, and you can start serving your notice period effective from the 16th of February.

During the resignation period:
1. It's best practice not to take leave unless it's unavoidable.
2. Knowledge transfer should be done 100%.
3. Cooperate with the management to ensure a smooth relieving process.
4. Also, if possible, you can help by referring someone for your replacement.
5. Be sure to duly complete your exit formalities.

Regarding your January salary, yes, it will be processed. In terms of the notice period, it depends on the terms of appointment. If the appointment order specifies a 30-day notice period from either side, you are required to serve it. Alternatively, if you have leave days in credit, you can opt to surrender 30 days and be relieved accordingly.

It is now May, and we are discussing February. As of today, nothing has transpired. How did this happen?
