Dear Friends, what is the number of daily and weekly hours of work in small companies and technology /software/internet startups in India? I have met employees working in such companies in Indian cities of Delhi, Mumbai etc say that their typical workday is 10-12 hours, 6 days a week. Online documents of indian labour law for shop and establishment tell that the maximum hours is 48 in one week.
Is the number of working hours of employees of technology/software startups different? Has the govt of india allowed more hours to small technology internet startups and sme in india? If not, then what can employee of such company legally do???

No, the law is the same for everyone, there is no exception for spread over and working hours. So those companies, that are violating the overtime provisions of Shop act or are having working hours beyond 48 h ours a week are violating the provisions which is illegal.The additional hours should not exceed 6 hours a week. The spread over is also prescribed as not more than 11 hours a day.
