The Factories Act under Sec.(1) is applicable to factories employing ten or more persons if the manufacturing process is carried on with power or to factories employing twenty or more where the manufacturing process is carried on without the help of power. However the Factories Act also empowers the State Government to apply the Act to any factory which employs less than ten or twenty persons also under certain circumstances by way of notification. Thus the State of Mahabharata has issued a notification in this regard.The implication of the notification is that the Factories Act is applicable to any factory specified in the Schedule which is carrying on the manufacturing process with the help of power though it employs less than ten persons or to any factory which carries on the manufacturing without power though it employs less than twenty persons.Trust the a mattet is clear.
