Simple question is if a director is appointed as a MD in 2013 without following due process of law or a money siphoning has occurred in 2014, or any sign forgery has occurred in 2014, can an application under section 241 of CA be filed in 2020.

What I understood is, a person is already in a board of directors with DIN and his appointment as director is registered with ROC.
Now he is taken as Managing Director in 2013 but till time, you say no procedure is done to take his name as Managing Director of the Company. You are making an allegation on him doing some frauds by him.
