i dont think there is any labour law for the probation period. Normally it will the policy for the company to keep employee on probation for a period of time , say 6 months or 1 year. but do not keep an employee on probation or as a trainee for more than 240 working days. please refer to an act called conferment of permanent status act, wherein it says that an employee should be made permanent or deemed as a permanent employee once he or she had worked for 240 days in a year. as far as the probationary and trainee period you may include as a condition in your company HR policy like one year, 6 months etc.,

Dear Sir,
i joined one company on 2011 jan. and completed 3 month PROBATION PERIOD on April 2011. and ask my company hr for a conformation letter. but no letter given after sending so many reminder mails & telephonic discussing no conformation letter provided to me. now they with some reason my company hr called me and ask me to resign i denied to give my resignation so they stop my salary and closed my company provided mail account from which way i can do correspondent with them i have a pay slip provided by company but no idea how to fight for my Rights.

My Name is Jaivir Selwal. I was working with a 5 Star Hotel at Gurgaon. I have resigned from hotel on 13 Jan 2014. I have joined in 01.07.2013 and i was in probation period as it is specifically written in my appointment letter that i will be in probation period untill I got conformation in writing whether after 6 months.
I had joined there at Rs.15100/-PM and was assured to revised my salary after 3 month but I didn't get anything in written about it. But They didn't revise my salary so I put resignation letter on the table of my HOD after 6 month.(but could not inform to HR).
As I was in probation period so I was not liable to serve any notice period.( In appointment letter only written that I have to give 1 month notice period only if I got Conformation. There is no point about probation period).
Now I was shortlisted in a MNC and they verified in hotel. The HR of the hotel said that I was a Absconder and did not fulfill exit formalities even if HR did not contacted me earlier. So I lost a wonderful opportunity.
Please suggest me some way( mutual or Legal) as it will be repeat again in next verification.

Hi, my name is kuldeep Singh and I am working in a central government PSU. I am in probation period for one year. A case on me which is cleared before joining. But court give me one probation which is also completed. Now my department asked me for submit the proof of clearance of probation which is given by court. I also submitted that certificate issued by SP, police. But my department asked me that the proof of clearance of court probation should be issued from court only. In continuation to this I approached to Public procecuter & advocate but they stated that court will not give such kind of certificate however certificate issued by police is enough for this purpose.
Kindly give me the suggestion that who will give the proof of clearance of the probation which is given by the court in a case either court or police.
