Hi,

First of all , i want to thanks all, those very helpful,very dedicated and their sincere efforts to help others.

I would like to share an incident that happened with me while i was working with previous employer BPO.I was terminated by organisation 6 months back.Currently i am not working anywhere and recently received all the Documents like PF from, F & f, exp letter.

I joined particular organisation on june 2011 and the company is a leading HR company in the world.All was going fine (my relationship with managers, senior managers) and i was leading the process quality chart( 2nd in the entire process).Our process works in night and morning shift and i was in the night shift(most employees were in the night shift and few were there in the morning shift).

On December we had a meeting with a DM of our process and he shared his view regarding rotation of the employees from night to morning and morning to night with some time limit.It wasn't like i am not interested working in night shit, though i was doing it for 2 years.However i had some medical problems working with night shift(can't disclosed that).

Lately my upfront manger made some decison , in this reagard for sending 3 people to morning shift.I asked my manager to reveal the standard they have made for sending people in to the morning shift as discussed by DM.She didn't revel it.As i was topping every quality and quantity chart this shocked me a lot.The reason givem by the manger was absurd.However than i revealed the medical reason with supporting docs.They had no choice just to sent me in the morning shift with the condition that i will be back in night shift after 2 months.I agreed as if no choice.

I thought whatever that had happend will end and everything going to be in the peace again.Later when i was in the morning shift, they used many tactics just to mentally harass me untill i leave the company.However i too have some vital evidences and proofs of the docs and telephone recording proving harassment.

They repetedly try to find errors in my work, my break exceed even slightly increase in the break slot allotment time.They used one of their team allocator just to eye on me and find faults in me whenever required.Though i tried every possible way to ignore all thier bully and harrasment and converge my efforts in production so that i can maintain the lead.

One day they found some error(shouldnt be clear as if it is a error or not without communicating me) they impose default consequencies,later found that it was communication gap and error not marked.However i had meeting with the manager and the allocator where instead of listning my grievences they tried to bullied me and presurrize me to improve behaviour.unfortunaly in that meeting my behaviour was rude and i somehow shouted and left a meeting room(as they are just not paying attention to what i was saying).

Though i complainted this to HR and they come in the role for the first time and decide not to join work till HR guys sort this thing out.I took leaves of 7 days without notifying anyone.Once i received the call from HR guy i again joined the organisation in the hope that they will do the justice to the process uplifter.

Due to their biased judgement, they served me insubordination and unauthorized warning letter. i lost entirely all faith in the organisation.However i still continued to work fine just to maintain the lead, never thought what i was chasing is too far from me as the obstacles were going to be much more broad and highr than my capacity to deal with!I too have the telephone recording of the HR and managers proving harassment on me with the strong tactics of malpractices and disfuntioning evidences.

After 1 month, i received another error, this time i had enough prrof as well that it had happend due to the inconsistent Standard operating procedure.But in that aspect as well they have their holding ego and self centered opinions that i have committed error and said " that everyone in the organisation , if they commit or have commited wiill acccept the error".

I refused to accept the error then agin HR issue raised. I opened the email and i found threats email from the HR to accept the error.

Than i took a bold decision to wrote an email to the CEO and relative respective members, atleast they should know what is happining in the organisation.I wrote two emails and i too have copy of that.

HR knowing that , had suspended me from coming office and gave 4 days to revert back the justification based on the show case notice, which i did reply on the time and well justified.Later on they have terminated me and gave me 1 month advance salary.I asked the reason, they just said you wil get 1 month extra salary and didn't give justification regarding termination.

They just said we have done in lieu of company policies and procedure and i have to accpet it with no options left.After that i have decided to leave the BPO forever because the perception i hold.

Neverthless, i found the desicion of being terminated satisfactory because this company could let me suicide and i am lucky enogh to leave the company on the time and saved my a**!

Now as i have remembered the whole incident while i was guiding one of my friend in the BPO suffering same issues, I think that it was all mess and i should had gone to labour court then and there. Or am i late now?

Can i still file a case on them if Yes then how?(I have evidences)

I think in this much time frame they too had collected some evidences against me or they can just say "Why are you coming late",

is it OK for me to go against them and sue them So that the thousands of people still working or aspiring people joining that organisation should not face this issue..I am very much serious to this cause.

Let me tell you that i too had signed the bond with them of 75,000

of 1 year , now as they have terminated me with no genuine reasons(and i didn't complete 12 month in the organisation) , due you find some significance of this in helping me to ask for compensation from them?

Hi Rahul,
I can empthatize with your state. You can definitely go to labour court. It will definitely disturb them but are you sure that you have the time and energy to fight it? As they can hire a lawyer who can keep you busy for a pretty long time. You know the status of our court cases. And then you have a career too, right? Focus on rebuilding your career. Many including you may disagree but being an HR I know you have to be diplomtic at times. But you should never misuse the profile you handle.
The more you involve yourself, the more frustrated you will get. Take a break. I hope they have not harmed you much by blacklisting or something like that. You should take hints and take certain calls on your job at right time. Unfortunately we do not have a strong justice mechanism.
While reading your mail I was expecting some suggestions, but seeing none did not surprise me!

Dear rahul,
The mistake which you have done is that you have taken an unauthorized leave of 7 days with out informing the management and your management has also issued the show cause notice. Since your explanation was not acceptable for them they have terminated you after the inquiry. They have also given you one month salary for termination. So they can easily justify their stand in the labour court. More over you have not approched the labour court in time. You have also lost more than 6 months. But it do not mean that you have no scope of getting the justice from the labour court but the chance is very less ie 25% stance.
According to me you should forget about the past and work harder because you are still young and you have years left in you and dont waste your time by going to the labour court.

Dear Rahul,
These things are happening in each & every company don't take it personally because in ur appointment letter section termination of employments clearly mention that both side one month notice for employee & employer they clear ur all settlement so search for another job and you have better future ahead
