I am laxmi working in Garment industries, 1 employee absent at last 10 days it's a unauthorized absent, in that middle 10 days one festival holiday is their, so that employee eligible to festival holiday.

Festival holidays wages are payable only if the emplyee had worked earlier or after the festival , otherwise he will not be eligible for it.

Dear Laxmi,
If any employee took long leave instead of Festival Holidays in the sence it has been treated as a absent only. We need not to pay any wages for the holidays even it is informed leave also. If the employee worked before and after Festival Holidays means they are eligible to get the holiday wages.

I completely agree with Mr Dinkar Sonawane. A workman who had worked on a day prior to festival and also worked next day he is entitled to wages for festival holiday. However a workmen who proceeds on authorised leave , any paid holiday falling at either end of leave period or during the leave period , workman is entitled to wages. Such days are to be excluded from the leave period.

I read your suggestion given to Mr. Laxmi, I think you are not aware with any company leave policy, festival paid days and disciplinary action during employee absentism, so first be aware with these topics and give suggestion to any one on the site of cite-hr.
