Initiating an action against a workman employed on probation depends on the standing orders or if you do not have standing orders, the appointment order. If the appointment order says that during probation the service shall be terminated without assigning any notice and without giving any notice, then you can take a call and terminate the driver. But the letter communicating termination should not contain any charge or wording that he has been terminated for the misconduct of not attending work, but it should only contain "following clause .....of appointment order or order ....of Certified standing orders, your service stands terminated". If you give show the reason for termination, the order will become a stigmatic order and then you should give him an opportunity to be heard. At the same time, a probationer shall be terminated without assigning any reason. But this will purely depend on the terms of appointment order or certified standing orders only.

As you know there is a nation wide strike of driver on 16th february, 2024. The employer ha to be proactive, since your's is an essential service establishment on previous day of the strike by arranging transport, foods and other things to retain minimum required manpower to run the day business.
You can call for explanation for a disciplinary action but will not stand because of legal ground of safety & security to life of employee. There are tons of cases manhandling of commuters by the people called the strike.
Targeting probationers is a soft target but doesn't sound good by leaving others scot free for the similiar misconduct.
One ground you can act for not providing information & intimation, for their absent.

There was a national-wide strike. Was this strike related to your industry? If so, were you given notice of the strike? If it was not of your industry, please explain how you were affected.

Did you give a warning to your employees and ask them to ensure that they report to work. Did you warn them of disciplinary action for participating in the strike without advance warning? Did you take steps to assure them of their safety?

If you did not do these things, then any court will consider the dismissal unfair and may reinstate them.
