Hi everyone, I wanted to share a common problem with all organizations. When an employee accepts all conditions and agrees to work but then stops corresponding with the reporting authorities and disregards the guidelines of the company, it can disrupt the working force. What should be the course of action? Even though everything was documented in correspondence and emails. I work as an HR professional in a company and I would like to find a solution. Can you help me?

Dear Lakshmi,

Employment for hire or reward implies, inter alia, the control and supervision of the employer over the person employed. When an employee blatantly ignores the instructions or guidelines and does his job in his own fashion, it means insubordination. The failure to communicate back is misconduct. When you have documentary evidence for this as described in your post, what's the solution you expect from others other than initiating disciplinary proceedings against the erring employee? Probably your hesitation is indicative of other reasons like the tacit support of higher-ups in the organization to the employee or you are unable to find fault with the results of his work.

What is the nature of the job? What correspondence are you expecting? What guideline is being violated? Is the guideline you speak of known to the employee? Was this requirement briefed to the employee upon joining? Have you sent him reminders asking for information? You need to be more specific in the post to get better answers.

Accepting all conditions of the employment framed by the company does not mean that the company can implement any conditions that are against the law of the land. Considering that the conditions are legally binding on the employee, and in such cases, if he does not follow those conditions of service, then it would amount to misconduct for which you have to conduct a domestic enquiry and take actions accordingly.
