I am running a small company and facing problem with one of the employees as follows.
He joined our company in 2013 feb as trainee on training allowance and we have committed to make him permanent on his performance after 3 months . He was indeed a skilled worker but not disciplined always late in coming and some times don't come to office and every morning give some excuse we thought he will change and given him appointment and increased his salary also but he keep on continuing the same style lots of absence authorized and unauthorized. Last august onwards his mobile bill has started increasing for connection company given to him and fact that he is not calling Ny customer or colleagues we have warned him in the first month itself but irrespective of that the bill kept increasing we thought of deducting it from his salary but because of leaves we cant do that .
Now in the month of October on duty he has lost his bag and company lost almost 1 lakhs worth of testing equipments along with bags and we had discussed him and we came to an agreement that we will deduct all mobile bills and 50% of the lost goods from his salary as per the amount he agreeing each month and we may write off full amount after six month based on his performance ( we prepared an agreement but not signed) after that he never reported to duty and he kept company mobile with him and again the bill has accumulated to another 5000( we cant Barr the connection as it is corporate connection and mobile company tells it can be done only on billing cycle) .
Now he is not responding to our calls for the last 3 months
Please advice us what action we can take against him ? Is it possible to recover our loss due to negligence and misuse ?

I would like to suggest you to First check your company policy, whats written if employees losses company assets, If there is not any policy os lost of damage then kindly kindly define one. “Disciplinary action” can be taken against the individual for any misuse, damage or theft of the company asset. So that you can avoid loss from these kind of issues if happens in future.
Further if empolyee has not given any proper resignation that go through with terms & conditions mentioned in appointment letter. As he did not inform you about his abseentism nor he his responding any or your call since 3 months and he has not surrendered office property as well (files /documents/office equipement - if any). You can also send him a show cause letter to him at his address.

It seems the employee is a technician or worker category. Do you have any proof for handing over the equipments to him? If not surrendered, you have to lodge a police complaint.
Is the sim card in the name of company or individual? If it is in company name, deactivate it to arrest the mounting bill.

Already you received some reply in this case. Mr. Pon has advised you to deactivate the Simcard. Hope you might have contacted the Service Provider. If the service provider is not deactivating the same then you are having the option to switch all the CUG numbers to some other service provider. If you put a word about the MNP to your service provider, then obviously all your problem regarding the mobile deactivation will take place.
Then, please send two letters to your absconded employee about his absence and in that letter do not forget to mention regarding the company property (including the lost Testing equipment materials) and instruct him to return the same without any delay. In second letter, after 10 days break, refer the previous letter and instruct him to surrender the company property and if he is not depositing back, then the company will take legal action against him.
In addition please lodge a police complaint against the absconded employee along with the materials list which he lost and not returned to company with a request to get back the property from the absconded employee.
Then obviously the absconded employee will come and surrender to you.
