Dear All, If the employee gives their resignation on 21 July 2024 and management accepts & relieved on 22 July 2024, but the employee is ready to serve his notice period.
The notice period as per the appointment letter is about 3 months, and the employee demands a notice period payment.
Is the employee eligible for a three-month notice period payment? If yes, then on basic salary or gross salary?

Putting three months' notice period as a condition of service itself is wrong and illegal. But having done so, the employee should be compensated for early relieving. The salary for the purpose of paying notice pay should be total salary and nt just basic pay. Naturally, if the employee is getting relieved early, without notice, what component of salary would qualify for that? Is it Basic pay alone? If you collect only basic pay, then you can also pay only basic pay as compensation.

Generally, "advance notice of one (or 2 or 3) months' is the norm in case of quitting/resignation or termination etc. Which otherwise mean that the employee putting the paper supposed to work for those months before he/she is relieved finally. So having worked during the 'notice period' the employee is entitled for gross salary. On the other hand if the employer accepts the resignation and prepared to relieve him then the employee has to be paid the salary for the period/months of Notice period as stated in the apptt.letter/terms & conditions mutually agreed. In your cited case this is what happening. Therefore the employee relieved immediately is entitled to notice pay for the (un-served) days he was not asked to work & earn.

These documents are asked to verify the current address of the employee. Normally the Adhar which is a legal identity card in India will bear only the permanent address. That is why lease deed, electricity bill or gas connection record is asked for. Out of these electricity bill may bear the name of the landlord only if the residence is leased one. But in India, we do not usually ask for these documents.
