My salary breakup is :Basic 27000, special allowance2850,HRA8100,Conveyance 10800, Medical 2083 (25000 pa), LTA2250(27000 pa), Ex-gratia 2250(27000 pa), Leave salary 4667(28 days).
They have given me a CTC of 7.2 last but leave salary is also one of the component. If I take 28 days leave, I will not get 4667 into 12 I. E Rs.56000. This also means 7.2 CTC with 0 paid leave. This is inhuman to not have even a single paid leave. To the world they show they are giving us 28 days leave but they are deducting the pay also. How fair is it. How do I tackle it. What could be other alternatives. I am working with an NGO.

Dear Anamikaatwork, Leave Salary is not deducted from your Payment.On the contrary Leave with Pay is quantified on PM/PA basis & included in your CTC

For every leave I take, they are deducting my salary. They had promised me a CTC of 7.2 lpa. They are fooling me with the CTC. They have kept my salary on holdand deduct if I take leave. This means I have a CTC of 7.2 lpa with zero paid leave.

They are paying me 6.6 lakh and 56000 will be paid if I don’t take any leave. This is so unfair. They can deduct tds, put but leave salary.

When you have been appointed, in the order of appointemnet, they would have mentioned your pay and other allowances and your leave particulars say CL, Earn Leave and Medical Leave etc; as per your Organisation procedure
What you have to observe here is, your total emoluments are cost to the company includes Earn leave of 30 days in a year will also include along with Gratuity( provided if you continuously work for 5 years you will get paid this gratuity)
From the above, it is inferred that and as mentioned, your leave pay is deducted from your salary, please check are you on loss of pay if not are you utilizing your casual leave which has not exceeded the limits. Since an organisation has given the commitment in writing that you would be paid the earn leave when you retire or resign as per procedures, you have every right to ask and go legally.
But it cannot prevent you from showing CTC inclusive of Earn leave or paid leave. So once gain check form your agreements what ate the facility which your organisation provides you.
Since you have accepted the appointments as per their policy and you have to check whether they follow their policy, if they follow, then blaming the organisation is not acceptable
So check once gain all the pros and cons.

I cannot help but sympathies with you. When Organisation are not professional then continuing there is not advisable.Since you are at receiving end and to accept all the interpretation of the organisation. Any organisation to succeed must be transparent and honest towards their employees. But still I cannot judge to take your side of view, There must be natural justice.
Every organisation will have a rider against their rule. Since when we join we accept all the conditions because of our necessity and survival. this weaknesses some of the organisation take their strength and if you are not indispensable and we will have to face the music.
So whatever has happened think that is for your good and Thank the Management .
