Dear Snel,
In most company the leave entitlement depends upon the "Company Leave Policy".
In most cases, all leaves are entitled wef DOJ. The employee can avail CL and SL as per company policy. However, PL can be availed only after Date of Confirmation. In Factory Act, Shops & Establishment, & under many other States Act the entitlement of PL is governed by the Legislating authority of the state. So you have to be very specific while calculating and allowing the "PL".
The No. of leaves entitled will be calculated wef DOJ. Availing the leaves depends upon company policy which is formed keeping in view the No. of employee, rotation, urgency of work etc.

Theoretically, Probation is only for ascertaining the proficiency of the employee; it does not or need not have any nexus with the leave entitlement.
