Hi,

An employee joined in August 2019 and conceived in the same month.
1. Is she eligible for maternity pay?
2. How is the payment done? Is it full salary or some other calculation?
3. As our company is facing losses and we have already terminated a few employees and reduced the salary of others, can we apply this to the pregnant employee?

Hi Anushri,

As per the act, to be eligible for maternity benefits, a woman must have been working as an employee in an establishment for a period of at least 80 days in the past 12 months. So, if an employee is working continuously, then she is eligible.

Full pay.

Dear Seniors,

I have one query. In X Company, there are some workers in a regular role and some in fixed terms. The number of regular workers is very low compared to fixed-term employees. Recently, we have reached a wage agreement for regular workmen. Now, the workers' union is demanding the conversion of fixed-term workers to regular workmen. My question is, "Is it necessary to consider their demand?" Management is currently unable to entertain their request. How long can we keep them on fixed-term contracts?
