Dear All - Would like to understand is it possible to prepone or postpone weekly off by 2 or 3 days due to work urgency/ medical emergency ??? If it is done,
1. What will be the implications?
2. Is it required to pay OT ??
3. Does it crossed the weekly 48 hrs limit
4. Maharashtra S & E ACT 2017 Chapter 3, Para 16 (C) says " If a worker is denied weekly holiday, the compensatory leave in lieu thereof shall be given within two months of such weekly holiday. "

Incase of emergency and exigency, workmen can be put on work on day of weekly off day or NH or FH what the case may be, but to be paid wages at the rate of twice his ordinary rate of wages/ both wages and with a compensatory leave as per the state rule.
The act and rules are flexible, however there should not be any exploitation of workmen. Therefore, you think how to motivate workmen to work on day of WO in exchange of compensatory off any day within two month or C Off with some monetary payment as your management considers best for the situation.
