can employer terminate employees with whom they have signed bond for three years and also taken security cheque of rs 80 thousand.

in that case what action employee can take against it

Hi , As per mine the employer can terminate the employee because of low performance , disciplinary action with out considering the bond of the employee. Wait for others replies also .

When there's no performance issue, why the termination? Any attitude or disciplinary issues? Just office politics may not lead to such situation--what's the HR doing then?
Doesn't the Bond have any clause related to resignation or termination? There ought to be something mentioned for sure. Pl check. Usually whatever is applicable to the employee is applicable to the employer.
If you already got the Termination Letter, what reason(s) does it give?
Coming to the Security cheque--I presume it's a PDC--pl give more details [as mentioned above]. I am sure there would some way out.

In HR dept there is only one person and she left the job last month,till now no one is hired.
and no termination letter is given just verbal communication,and taht too nothing specific was specified just that ur performance is not upto mark.
i am working as admin exe.
Bond says that under probation period employer can terminate employee performance issue without notice period.
Cheque is PDC.

What does the Bond say if the employee wants to leave--how much notice period?
Also did you ask about the PDC when they told you reg the termination?
You say that they mentioned the reason as performance-related. So you can be sure that they will find [if need be, cook-up a few things] some reasons to show in case you insist on knowing the reasons in writing.
My suggestion is this: just focus on getting the PDC back & look for other openings. Pl reply reg my query about PDC. My feeling is they may not refuse--unless their motives are different.
If you haven't asked them about it so far, ASK. Since they told you to quit, allow the facts--whatever they may be--to come out into the open. Like they say: cross the bridge when it comes.

Dear TS, thanks for your reply. Bond says emp has to serve 3 months notice in case she/he was to quit. i had not asked yet about the PDC as everything was verbal. Regards, Sonam
