There is no restriction on the no. of employees. It is the perogative of the local municipal corporation to collect PT. Once a company is registered under the Shops & Establishments Act OR The Factories Act in any Municipal zone, the PT will have be paid as per the local rules as laid down by the local Municipal Corporation. The only criteria is the amount of take home salary. Deduction by employer and depositing it to the govt treasury is mandatory. For further information, you can get in touch with any good local tax consultant.

Dear Madhukar,
Akshay Bapat has rightly interpreted the professional tax, as in the state of maharashtra it is covered to those who are earning by their own stack whether employer or employee. i wish to explain one additional information that for 10000 & above the rate is 200/- p.m. and in the last month i.e. February it is Rs.300/- to meet utmost slab of Rs.2500/-.
Senior Citizens, physically handicapped employee or even employed father/mother of disabled children are having relief from the act and remittance.
