this is the first time to me to have entered in business on my own, i am in a situation to frame my employees leave schedule, i am running car spa , a customer oriented concern which i have to keep run even on holidays for customer convenience in such case my business is mainly on holidays and week ends , and how should i frame leave schedule to my employees and and how can i calculate salary , because of leave days i am little confused in this aspect, i concern much about employees and i have to convince them too i need expert guidance, kindly suggest

Dear Vanishya,

It appears that you have confused yourself with "employee leave" and "weekly off". Both are different. Therefore, your first concern should be to apprise yourself on these basic concepts.

If you are running a car spa then you are covered under the shops and establishment act. Therefore, you may read this law of the state to you belong and get acquainted with all the concepts mentioned in the statute book.

Going further, it appears that your business challenge similar to the employees who work in hotels and restaurants. Hotels and restaurants too get more business during Sundays and holidays. Therefore, you may approach someone within your circle and find out how do they manage the weekly off the employees. Generally, weekly off is given from Monday to Thursday. If your employees work on "Closed Holidays" then you need to compensate for those offs also.

Lastly, to avoid the legal hassles, you may hire HR consultant for a while who could set HR systems and processes. Thereafter you can be on your own. You may consider consultant charges as investment rather than cost.

Dear Friend,
Really it is the most appreciable as you are concerned with the employee, and My best wishes for the success of your Car Spa..
1) You can have your employee 8 hours a day and that should not exceed 13 hours on any count, and the extra time after 8 hours should be treated as over time with salary of 1.5 or 1 as your business progress..(with 3 breaks)
2)The total working should not exceed 48 hours a week including over time..
3) weekly rest is one day off with full pay..
4) annual leave is 20 days in case of five working days, 24 days in case of 6 working days..
Please get in touch with others who are running in the same kind of shops nearby for good advice, even though these are guidelines available, the local people know more than on ground truth...

Dear Mr.Gopinath,
Your suggestion is welcomed. But the annual leave is 20 days and 24 days in case of five and six working days respectively you have mentioned. But can you please elaborate in detail how you have arrived this and which law is specified. Whether any minimum number of working days required or not for entitlement of leave ? since you have mentioned on random figures.

Dear Friend,
When you increase the working hours, the consequent of giving leave increase( 24 days ), this is because you are considering 6 working days, in case of five working days, the working hours is being less accordingly the annual leave is also less ( 20 days ) this is because there should not be any violation of leave procedure. This is very much in leave rules 1972, Govt. Sector, however, in private sector, changes are inevitable you cannot adhere all because of the situations that you are going to counter. Try to adapt in principle and practice, rest is undeniable. Kindly get yourself consulted with the local people, initially, you certainly have to face problems in the long run you will adapt to the practice, and ground truths.

Dear Mr.Gopinath.
Your suggestion is not within the purview of the Leave Rules as stipulated in the Chapter VI of Shops and Commercial Establishment Act. You are referring " this is very much in leave Rules, 1972". In which enactment is mentioned, can you please clarify. If the employer, is allowing the benefits to his employee over and above the leave rules can do so, provided if any agreement between the employer and employees, or standing order or by framing his own employment rules .
