Entitlement for Gratuity arises on completion fro five years continuous service in an organization. So you are not entitled for gratuity.

That apart, so far we have discussed w.r.t. the Payment of Gratuity Act. What is the scenario in respect of Estts. to which Gratuity Act is not applicable and their employees are under CTC regime which includes gratuity as a component. One may say it should be governed by what is stated in their applicable Gratuity Scheme. There also could be a clause to say gratuity is payable for more than 5 yrs. service.

Yes gratutity should be the component of the TCTC as per my view CTC stands for cost to company which means what is the cost of company of that employee, inculdes employee payment and employer expense.
