Dear He has worked only for 4 days. Why you are asking for his resignation. Don’t pay any amount and don;t ask any resignation etc.

This is a common practice now a days especially in sales function, when looking for a change people take offer to more than one organization and join also. in case if they get a better offer before they have signed the appointment letter they disappear like this. most of the time you cannot do take any action against them as they are not in agreement with us for the job. Mostly organizations blacklist such candidates for any future openings.

Hello Neelam,
In continuation to the above mentioned responses speak to the candidate and ask him to come and resign in person. He has not collected the letter of appointment please check in the employee's file whether he has SIGNED the letter or not.
If he has signed then accept the resignation and mention in the comments that notice period not served (please check your company's probation policy regarding the same) and recover the dues if any.
We ideally cannot initate the absconding process since the employee has already send his resignation letter via email.
So my recommedation would be to close the case by accepting his resignation and mention in the comments the employee left without serving the notice period
( please check the probation policy) and he has dues pending.

Dear Neelam,
You have not issued him appointment letter and hence technically he is not your employee yet as he did not sign any document. Sending letter or absconding notice is not required. please erase his attendance from registers and keep quite.

It is very important to understand from employe side as well, sometimes companies do not respond positively and employees think about there job security. But working for 4days is like a guest came at your place. Let him go and do not think about him.

As preetam deshpande rightly said he has not accepted the appointment letter which means the contract between him and the company is not complete as yet.I feel there is no point in pursuing the case any further but just accept his resignation if other areas are clear.(for example no company documents are with him or he has not accessed to any confidential information etc.

Firstly an appointment letter should have been issued the day the employee joins.If you say the employee joined you on 26th Nov; and stopped coming since 1st Dec - you had five full days to give him the letter. Why was this not done?

As this would show his commitment and acceptance to the terms written.

Secondly, if he says he has a better offer this would mean 2 things:

Trying to renegotiate or he was waiting for a confirmation from some other company and yours was a stop gap arrangement.

In either cases i think he is not a resource worth hiring as for money he/she will leave any time.

If you have any proof that he joined you you can send him an absconding letter and follow your organisational process to ensure audit norms are met.

and if you can get to know his current employer; you can inform the HR there that the employee has not completed the formalities in your organisation.

Ensure you send an email to the candidate so you will have basis to talking to HR (of the new employer)

Employer can take action against employee who doesn't comply with company rules & regulation.
That employee should pay to the notice period. This need to inform to all employees that any person who wants early release should inform to company(approval from management), if approved then they can release early but if not they should pay the notice period. If he left the company without any notice/resign letter(no show), you can take legal action to him, try to contact him first
