Gratuity is nothing but a retirement benefit for employees (in very simple terms). To avail of this benefit, an employee has to work continuously for a minimum of 5 years. If an employee passes away or leaves/separates at any time within 5 years, they will not be eligible for gratuity.

Dear Sir,
I joined the company in 1997 and left in 2005 due to the company being sold by the owner to another party. Before the new owner took charge, I resigned from the company, but my superannuation was not paid. The company I used to work for (from which I resigned) claims that they are not liable to pay my superannuation as the company was sold. Additionally, my outstanding leave salary has also not been paid by the company.
I am seeking advice on whether I can take any action to receive my superannuation and leave salary.
