Hi,
You will have to live with this situation. Legally they have the freedom to take 12 weeks fully paid maternity leave and on joining back, leave the organization. However the recourse you could think of is something like a notice period for resignation, so that it gives you a breather.

Hi MadhumitaI think there is a labour law which says that if any organisation is having 20 or more women employees, opening a creech is compulsory. If you open a creech, your problem will be solvedRegardsJyothi

Tough one..our employees have had the courtesy to accept the salary on return. Pesumably it boils down to whether the individual wants the job or not.

My dear friends, I would like to suggest all of you that, when you receiving the notice of maternity leave you can recruit contractual employee for such period of three / four months and if contractual employee's performance found satisfactory you have the option to take him / her as regular employee if requirement, otherwise their contract shall be automatically terminated.
