Hello Anir,
The sooner you realise that your Company is playing football with you, the better.
What would they get by doing so? There are, unfortunately, many such companies in India--especially in the IT sector--that use such coercive tactics.
Pl go thru my earlier response--I had sort of expected some such trick when I asked you to consider seriously about going to the media. No point telling your HR about it--just go ahead & do it.
Also, to consider a worst case scenario: Is your company capable of telling everyone that it was YOUR decision to stay there & work on Business Visa--in the light of the fact that they are bluffing now about the Notice period being 3 months instead of 2 months--if they get to know that you could be contemplating some drastic action from your end? Just think about it?
I only hope you have retained ALL the correspondence with you without deleting any of them--you never know what you need when.

You go by the law and not by the term of your appointment. The Term must be in conformity to the law and not the vice versa. Tell you company in no unequivocal terms term that the company's term and conduct is putting you to commit illegal acts. Tell the company that the terms are ultra virus to the law and cannot be put to operation any further. Tell the company to sort out the matter immediately. Till such times you are moving back to India, as the law does not permit you to stay in an alien country illegally or by adopting to illegal ways to continue. The onus will be on the company.

Surendra - Plan to take any crap from them till my notice period is over(as just 8 more days left). Post which they have no right to tell me anything. Made it clear to them, but they do not seem to understand this. But let me not care.
