termination cannot be done with immediate effect untill and unless a formal enquiry is done, employee being charge sheeted and the report of enquiry is submitted to hi m for a chance to reply.
but,please check whether he has completed his temporary period and he comes under Industrial dispute act-Workman category.
if you can explain about the clear case, defnitely clear guidance shall be given

Dear All
Termination with immediate effect, is based on Theft, Rape and other illegal activities like Fraud, Bribe etc., but it should be proven in ground otherwise the employee can go and approach the nearest ACL for help. For Non Performance also, you cannot do it simply, you have to show the genuine reasons as per Principles of Natural Justice.
