Please don't misguide juniors. Just because Vijay Mallya can hold the salary of Kingfisher staffs, it should not become trend to do so. While giving opinions in the public forums, you should always take dispassionate look.
I am little surprised. Do you give these kind of HR Solutions to your clients which are contrary to the law?
Any business leader should be intelligent enough to know about the ups an downs of business. If business were to go down, he should have kept sufficient cash reserves so as to pay to the staffs. Let these so called business leaders should not do business at the expense of the employees salary. In India anyone can do the business but it should be done within the framework of law. You cannot give short shrift to the law.
Cases of this kind do not happen in USA because laws are very strict. Business owners of this kind would have been jailed for non-payment of salaries.
These very labour laws came into existence to avoid exploitation of the labour. Unfortunately the implementation of the labour laws or any other law for that matter is so weak that business owners can get away with any nonsense. Solutions providers like you are ever ready to sing paeans for these defaulters.
For Abhijit: - You need to take up the cudgel against your employer and report matter to the labour officer of your area. If labour officer is also unable to solve the matter then you may approach labour court through some lawyer. You will get justice that is sure. You don't have to forgo even day's salary. If you happen to file suit, make sure that you include the clause of issue of service cum experience certificate as well. This is because to take revenge, he may not issue experience certificate.

2 months salary is not a coffebite chocolate to let it go!!
All our employees are not so well settled and living their lives with well sophisticated luxuries !! Think of the cost of living, the dependents, financial settlements like loans, if the employer fails to pay continuous months where shall they go and what shall they do for all those, will your bank accepts the delay in paying the interest amounts?? or will they facilitate for any concessions hearing to your reasons for not getting paid by the company yet?? This is India, and population is huge, maintenance obviously is difficult still we are ahead in all without being the burden on the government for living, depending on the wealth of nation, employees do not accept the salary as charity they earn it !!..........

Practically nothing can be achieved by Payment of Wages Act.It is not applicable to persons with salary above Rs18000/pm.It is applicable to COs under S&CE Act unless govt notifies so.Action by Labor Dept is possible But its speed &outcome is limited .Even after that if the employer is not paying wages maximum punishment is fine of Rs7500/-or attachment of employers property.If he has no property in his name attachment is impossible.This kind of ineffective laws are breeding grounds of trade unions.

In keeping all the opinions expressed in the above i wish to put my experience in life with otherthan govt service as
- during private job give and take policy should adopt if there is no pay why should u beg for salary without work
- alternative employment should be chosen in case of crisis in job
- give suggestions to overcome the situation
- merely demanding salary is not only solution, demanding or searching alternative job on the basis of job experience gained
**knowledge is power** think in this direction

In addition to the discussions above, I would like to suggest you...which might be weird.. but will work out..as I had tried it before..
Instead of getting into legal steps directly..to avoid complications...
You can talk to your CEO in soft manner.. as you have done it earlier and things are not working out...
Go as usual to your boss' cabin..sit with a crossed leg in front of him..give him a stare into his eyes and from top to bottom and just say only one dialogue....
DO YOU WANT ME TO APPROACH THE MEDIA/PRESS TO GET MY SALARY...???????
SInce it is a small company, I think your boss would be a little worried when it comes to media... show him the number of some media in your mobile and I think this would give him an enough dosage and I suppose this would work out... :p 8)
Take a chance and try.. If it doesnot work out.. get in legally......!!! :lol:
And I warn you, you are not coming to office to maintain relations with your boss nor to make friends and maintain it forever..I suppose you understood what I meant by this..
