Please help me in giving weekly off to the employee if condition is as below-

if an employees is on leave Monday to Thursday than he is illegible for weekly off on Sunday
if an employee is on leave from 26/08/15 to 03/09/15 than he is illegible for weekly off on Sunday (30/08/15) or Sunday (06/09/15)

Dear Somnath,
There is no notification for the same, you can find it in the Act itself in the Leaves section. However it does not means that if a workman only literally works for six days only then he is entitled to get leave. No it is not. Those six days may include any holiday or leave which may fall during the week.

As per my knowledge ( It may Wrong ) In Model Standing Order their is clause for W/O or Paid Holiday, that concern employee may physically present sufix or prefis on the Holiday, that rule we going to use in Paid Holiday or in Weekly Off.
This rule is applicable for those Company who paid 30 or 31 days salary , some comapny's who are paying 26 or 25 days salary that companys are not applicable this rule for only Weekly Off. it is applicable for Paid Holidays only.

I have searched a lot for 26/30 days but not able to find any concept for 30 days nor did i find any judgement.

In my opinion it is clear in the Factory Act that person who works for six days in week is entitle for weekly off in case of monthly rated employees. However it may be prejudice that six means how many working days fall in week, because of National & Festival Holidays working days may be less than six i.e. all the working days falls in the wseek. It may be made clear that Leave with pay or sanctioned without pay may be considered as working day, but absent in the week may never be treated as working day and a person remains absent without information to the employer should be punished for deduction of weekly off. Because some small category o employer may suffer loss for absent of even one worker.

kindly clarify me as per rule after six day , one holiday will be given by employer , is this one holiday (weekly off) is paid holiday or unpaid,
