Hi R.N.Khola,
What types of Leaves applicable who work in a Factory that come under Factories Act. Example is the leave policy equal for Managers, Officers, Sr.Executives, and to that of Workers. I understand only PL leave is applicable. Is CL and SL applicable in a factory if so these leaves are also applicable to workers. Can you please clarify.

Dear Ravindranath,
The worker as defined under The Factories Act, 1948 is entitled to leave with wages as per chapter VIII of this Act. A worker is also entitled to National & Festival holidays and Sick & Casual Leaves under the State Industrial Establishment (N & F and C & S) Act if the State has enacted this Act for workers working in factories. He can also avail sickness benefit if covered under the definition of the employee under the ESI Act, 1948. A female worker can also avail Maternity Benefit under ESI Act or under The Maternity Benefit Act, 1961 whichever the case may be. After finalizing the applicability of the Act we are to go through the definition of the beneficiary i.e. worker/ employee who become entitled to have these leaves. If any of the persons working in factories who is not covered under the definition of the worker /employee whichever is there in the Act then he will be getting the leaves as per the leave policy or Rules of the unit.

(Fact Check Failed/Partial)-The user reply contains inaccuracies. The leave entitlements, such as National & Festival holidays, Sick & Casual Leaves, and Maternity Benefit, are governed by separate Acts like the Factories Act, State Industrial Establishment Act, ESI Act, and the Maternity Benefit Act. The Shop & Commercial Establishment Act primarily deals with regulations related to working hours, overtime, and weekly offs.
Dear ---
You must be knowing that Shops Act is a State Act & therefore you are advised to through your State Shops Act for taking decision on the matter of sick leaves.

What is the number of Casual Leave, Sick Leave and Prilivege Leave defined under Bombay Shop & Establishment Act
From India, Mumbai
From India, Mumbai
CiteHR.AI
(Fact Check Failed/Partial)-The user reply is incorrect. The Bombay Shop & Establishment Act does not specifically define the number of Casual Leave, Sick Leave, and Privilege Leave. It is typically left to the employer's discretion, as long as it meets the minimum requirements set by the respective state's labor laws.

(Fact Checked)-The information provided in the user reply is accurate. It correctly highlights that the Shops & Commercial Establishment Act is a state-specific legislation, and the leave entitlements vary from state to state. It is advisable to refer to the specific state's Act and Rules for leave provisions. (1 Acknowledge point)

Dear Naresh G.
A number of leave policies are provided by the members at different forums of this site & you can also down load leave policy on this site itself. This is also to inform you that Shops & Establishment Act is not a central Act. This is a State Act & different State Shops Act are having different leave provision. Therefore first see which State Shops & Establishment is applicable in your case & then go through leave provision in that Act & change the leave policy accordingly keeping in view the number of different kind of leaves as are provided in the applicable Act.

(Fact Check Failed/Partial)-[The user's reply is incorrect. In a factory under the Factories Act, different categories of employees may have different leave entitlements such as earned leave, casual leave, and sick leave. The leave policy is not necessarily equal for all categories of employees. It is important to refer to the specific provisions of the Factories Act and any applicable state rules for precise details.]
