(Fact Check Failed/Partial)-[The user reply does not address the original query about the leave policy under the Shop & Commercial Establishment Act. It seems like there was a misunderstanding. Please provide information on the leave policy as per the Act for Deepa's query.]

  • Dear Deepa
As per Shop Act, we have to give 12 casual leave , 12 Earned leave and 12 Sick leave. Total 36 days. This is the bare minimum leave prescribed under the ACT. However, nothing prevents the management to increase the quantum of leave.
EL is allowed after completion of one year of service.
Unavailed Casual leave stands lapsed and shall not be carried over.

  • Mr Sreeniwasan, Is it mandatory to give 12 CL and 12 SL, as what I knew was that minmum of 12 days has to be given as CL or SL. Cant we combine the two? as in just 12 days of SL and CL.

(Fact Check Failed/Partial)-[response] It is mandatory to provide a minimum of 12 days each for CL and SL separately under the Shop & Commercial Establishment Act. They cannot be combined.

  • Deepa,
A total of 36 days leave is mandatory. 12 CL,12 SL AND 12PL(Previlege or Earned leave). Accordingly registers need to be maintained every month for all employees. Leave not taken need not be carried forward or encashed.
The following attachment are the list of registers to be maintained as per Shops & Establishment act. If anyone could give me some tips on how much mandatory is it to maintain these registers or anyway that i could reduce these manual work....?

(Fact Check Failed/Partial)-The information provided in the user reply is partially correct, but there are some inaccuracies regarding the leave policy and the number of mandatory leaves under the Shop & Commercial Establishment Act. The Shop & Establishment Act typically varies by state in India, and the specific leave entitlements can differ. It is essential to refer to the specific state's Shop & Establishment Act for accurate details on leave entitlements and register maintenance requirements.

(Fact Check Failed/Partial)-The user's reply is incorrect. Under the Shop & Establishment Act, the company cannot reduce statutory leave entitlements like earned leaves.

  • Dear Venkat,
First decide under which of the Acts your unit is covered i.e. Factories Act, Shop Act or National,Festival Holidays & Casual & Sick Leave Act & thereafter go through the Leave provisions for different leaves. In general it is hereby told that CL & SL lapsed at the end of the year & EL may be carried forward to a certain limit.
    Comments submitted as requested.

  • Dear All
All of us are talking about Shops & Commercial Establishment Act but you will be knowing that this is not a central Act. This is a State Act & therefore we can not name as Shops Act. It is hoped that each & every state must have enacted this Act. The name of the Act will go by the namae of the state e.g. Punjab Shops & Commercial EstablishmenAct,1958, Delhi Shops & Commercial Establishmen Act etc. Different types of leaves varies from state to state. Thus is advised that plz go through your State Act & Rules and then decide the matter in question.

  • Hi Deepa

I hope you are working for a company located in Kerala. As per the THE KERALA SHOPS AND COMMERCIAL ESTABLISHMENTS ACT. 1960, Chapter - III, an employee is entitled to the following:

Annual leave with wages.-(1) Every employee in an establishment shall be entitled after twelve months’ continuous service in that establishment, to holidays with wages for a period of twelve days, in the subsequent period of twelve months, provided that such holidays with wages may be accumulated up to a maximum period of twenty-four days.
(2)Every employee in an establishment shall also be entitled during every twelve months of continuous service (a) to leave with wages for a period not exceeding twelve days on the ground of any sickness incurred or accident sustained by him and (b) to casual leave with wages for a period not exceeding twelve days on any reasonable ground.

Thus it is clear that at least in Kerala, the minimum number of casual leaves and sick leaves are not defined.

    Regards

    Mahesh.
