i would like to suggest something related to this matter.
Nowadays company is looking a best talent which is good for company growth. Normally when somebody has selected for some responsibility then it means person is capable. In todays business world, you cannot faith on anyone except what you are looking and what you are feeling.
References to get the information not to faith on it completely. Talent cannot hire it can notice....

I want to believe that the employment is dependent on favourable check results. It follows therefore that if the check result is not favourable then the employment cannot hold. But before you can conclude, please make sure that the former employer is telling the truth. Some people can be mischievous and/or wicked and write negative reports. If, however, the report is true and the new employer really has a bad report, then you can terminate the employment immediately.

Why was an offer made BEFORE all referee checks were done?
I have said time and time again in these forums that recruitment is not rocket science. It can be very simple.
BUT you must have a complete process in place, and all staff trained to follow that process to the letter.
By not following a proper process, you leave your organisation open to legal action and other sanctions.

What can be done, if the ex-company refuses to provide the information, in our case all the documents are accurate and BG agency requested for authentication, the HR is saying they won't provide any information as the employer has joined his client which is breach of NDA ( No copy of NDA is with any of employee nor they are providing a copy and no one remembers that there is a document of such)
