When notice period not provided in offer which law is applicable under resignation law in India?

Leaving aside the legality part, by virtue of one's role and responsibility, one has to follow the proper exit process and ensure a smooth separation from the employer. At times, going solely by the verdict of the law will not be beneficial. If you leave your employer abruptly, stating a nil notice period, the employer may take the opportunity to respond adversely during background verification or reference checks tomorrow.

If the company does not mention what the notice period an employee should serve, then which law will apply?

If the employee serves the notice period of 2 months after his resignation email, as per standard, is okay or is there any rule that states the employee should complete a certain period of time if the employer has provided the notice period in the offer letter and the employee has not signed any document.

Kindly explain....

If there is no separation clause (notice period) in your appointment terms, you can discuss with your employer and establish your relieving date, which may be immediate after submitting resignation. However, get the concurrence of the employer for a smooth exit process.
