Complaints means complaint made following which Act? If the establishment did not have a Committee mandated by law to prevent harassment against women at work place, you can move against the company for that. If your issue is not harassment but termination, then the court is there to intervene and get your dues paid or reinstate you. But if you have been working in a supervisory role, you cannot get any protection Industrial Disputes Act- as such it is meaningless to go to court and battle against the company. After all, you were under probation. Termination as retaliation cannot be proved in the court. before the court the only question will be:
1. Was the employee under probation?
2. Whether there is a clause which permits the employer to terminate the employee on probation without notice and reasons?
3. Whether the order terminating the employee contains any reason for termination? if yes, is it stigatic?
In this circumstance, going strictly by law is not practical but you can explore the other options, approaching the District Collector or such other agency who is to ensure implementation of POSH..Act etc

In USA, there is EEOC which takes care of retailiation absurdity by employers. What about in Bangalore? Its been 2 months without pay. October pay I got with help of cops.
I met dcp and gave complaint on Saturday. He will forward that to local PS.
Women commission complaint still pending enquiry as chairperson is on official tour.
Labor commission was of no help and was just a timewaste sorrow.
KSLSA had taken a letter last Tuesday 15.12.20 to get my case file from labor commissioner.
DCP complaint given on 19.12.20
I sent email to USA eeoc but I will not be covered probably as I am not USA citizen. Though company is US.
Who can provide immediate relief and peace in this case?

Dear Anu, Only POSH act 2013 can help you in your case, I am enclosing POSH act for your reference.

The case is fit to be heard under POSH Act. Pl file a complaint immediately to the District Authority (Collector office) regarding non availibility of Internal Complaint Committee under the POSH Act and also for not filing Annual Return under the POSH Act . If the District Authority become active the company will learn a lesson to respect female employees. The reinstatement issue is not primary but sexual harrassment is primary. concentrate of POSH Act which will be more beneficial in this case.
