Dear Divya,
All units covered by the Shops and establishment Act follows the working hours, weekly off, total days as per the relevant Act. The Shops and Establishment Act is essentially a State Act and is passed by the State Assembly. Like in West Bengal we have the West Bengal Shops and Establishment Act which states that there should be 1 and 1/2 days off every week that equals 5& 1/2 Working days.
Please check with your State Act for clarifications.

Dear Rajat
Just for clarification. Why do we need to hide employees attendence if they are working on holidays. Is there any law to it.
Because as per my exp...we had hired many people on contract...it is a very common practice in engg companies...
the employees are paid fixed salary with specific details mentioning abt any leave if applicable, or any benefit applicable.
The contract letter should be very clear in this aspect so that there is no confusion.
So if thier contract letter states they have to work 6 days a week , no pl, cl, sl applicable & national holidays are applicable. Then they have to be paid for any day they work on weekly holidays or national.
then you have to divide thier salary accordingly i.e. salary per month/ no of working days in that particular month (excluding sundays)
This is how we have been doing.

Asha
