Dear Niralihpatel, You are talking about Independence Day not about a normal paid holiday and for your Kind info its a Total Off day and you can’t take work from employees on Independence day.

The general rule is that in the event a company deploys contract labourers it must obtain license. However if the company sub contracts the work the contractor must obtain license vis a vis its principal employer and the contractor must obtain registration as principal employer vis a vis the sub contractor and also must ensure that the sub contractor obtains a license to provide services. A sub contractor cannot take a license vis a vis the company which gave the work initially as there exists no legal relationship between the sub contractor and the original company.
Hope this clarifies the issue.

The problemcould be that there is not sufficient ventilation arrangements, due to which the emplyee's are possibly using the excuse for not wearing safety goggles.
Further, you can look at a shock threrapy kind of treatment...give them an indication of the damage and long terms effects of them not wearing safety equippment...this should make them consious of the fact that safety first...comfort later.

Dear Niralihpatel,
If you are working on any holidays declared by the Factory. The rate will be:
One Day Attendance + Twice Rate for Hours work.
i.e if a person works on a holiday he will get 24 hours pay for working for 8 hours i.e 3 times.
As for your second question, violation of safety rule, disciplinary actions can be taken.

Dear all if an employee worked on Public Holiday we have to pay Twice the wage or C/off as per AP Factories and Establishments(National Festivals and Other Holidays)Act 1974 under section 3, and for the second Question disscus with ur superiors and chang that Gagools. As per safty precations providing gagools is not an issue but to give safty mesures as confort and good working condition. so if they are not comfort with that gagools try to change those. if u take Diceplinary action they have to complaint againest u. you did not provide good mesures.
