I am working in private sector firm which comes under ESIC. Now I want to take maternity leave under ESIC but ESIC doctor saying that she will issue a certificate only for 84 days leave because she doesn't have GR. But as per my knowledge ML is increased from 84 days to 180 days.
Please give any suggestions.

I wanted to confirm in case if the amendment is effective, as it mentions employees covered under ESIC. In case if my organnization is under ESIC, will it be applicable to by Organization?
As the name suggests it is for leave, in case if employee does not join back, then in that case will the company be advised to maternity pay.

I am in maternity leave from October 2016 as per the old policy I got my 12 weeks payment as per this new policy by this month end I am going to finish 26 weeks so will I be able to get those balance 14 weeks payment as well or this new rule effects only for the employee who deliver after 9th March 2017 or what???? Can Anybody clarify about this.

if an employee went for the maternity leave after giving the leave application all off sudden after birth the child died. she said i want to resume the duty with in 8 weak... and she joined. how the remuneration is payable.

I think, if she has decided to rejoin, that is her choice. There does not seem to be any specific provision for this in the act. She will get paid if she comes to work or does not work.
If she rejoins, she gets her normal salary for working, she has waived her rights to rest of maternity leave.

First of all very sorry for replying very late. Though I regularly go through the articles on daily basis, but your query missed. I have gone though it today only.
You are right, the MB under ESIC has been increased to 26 weeks (182 Days). The Doctor is not supposed to say like this.
However, pls find attached the govt notification being issued by Ministry of Labour and Employment on 20th Jan 2017.
Your post is dated 29th Jan and the notification is dated 20th Jan, so as per my opinion you are eligible for amended benefits under the Act.
