Dear Preetam,
Terms & Conditions in Appointment Letter are 3 months Probation period, & 1 month notice period. Confirmation after successfully completing probation period.
Though he had not collected the appointment letter from HR Dept, all the terms & condition & policies were explained to the employee. And was asked to collect the appointment before leaving the office, as to avaid any duscussion related to appointment letter or salary package within the department collegues.

guys though i am not a professional HR, the point here is since the person has not collect his appointment letter from hr dept, it is obvious he has not signed on , which means in simple terms that officially he has not accepted the offer of joining company, though practically he joined for couple of days!!
hence he is not liable for any explanation nor can any action be taken against him as per the law and hr regulations.

as per my experience i think it could be some one who must have come to spy ur company
(or)
may be got scared regarding the company infra and culture
(or)
may thought that it must be not suitable for him
(or)
must have just come there to check his IQ level regards interview.....
these are angles which we can think if the guy have relieved from the company with out prior notice::::
i do feel that HRDS should handle these things as special cases and trace them for what reason it is coz , in my previous company i found two spying me and company server control .......

Hi,
Nothing can happen to Employee as he didnt accept appointment letter as he is not a employee of any company. Now employer has to sign his letter at the time of joining kit.
I dont think that that employee is worried about his 7 days of salary.

How much you value the mangement time.How much it would cost you in terms of your time and energy if you go after a guy who did not even collect his appointment letter and was just with you for four days and who, I am certain, will not be bothered about collecting his salary or your relieving letter. Why to enter into any kind of communications with him desperately seeking to know as to why he left the company or if he does not reply, which Iam sure he will not, why to allow your imagination to run wild, indulging in guessin game as to what would be the probable cause for leaving or frantically exploring options as to how to proceed agaisnt him for absconding.Is it really worth the management time? I understand that one needs to undertake this exercise, if it were an employee who served the comany for two or three years and resorted to this kind of act of disappearance. In my view, it is better to close such files as early as possible so that you can shift your focus to more important tasks on hand.You can take the follwing steps

1) mark in the muster roll agaisnt his name 'resigned with effect from.....'

2) Keep the appointment letter and his resignation letter in the file.

3) Settle his 4 days salary, if your company has no objection (so that he may not pester you for this and engage you in correspondance which is a waste of your time).

Dear
1. Until he/she receives and acknowledged the Appointment Letter (not the Offer letter) AND
2. Until he/she submits his joining report AND
3. Until he/she signs the Company's employment agreement (if any).
One can't be treated as Employee of the Company, hence no action can be initiated against his as per LAW.

As long as the offer letter is not received by him there is no problem. Just keep quiet. He will never contact you again as he would have got other opportunity or may not be able to continue for reason best known to him. However if he ask for the salary for the days he worked you can tell him that it is not possible as the offer letter is not issued and he is not covered under the employment in your company

Hi B.Saikumar,

As i was on probation period in my previous employer and i had given resignation and had given notice period of 9 days bt mail because my head office and hr is in delhi and i was at ahmedabad.

i had given 9 days notice period as per my appointment letter issued to me.

Now at last day of working they send me mail and informed me that they are not ready to leave me untill new employee will come and they stuck my salary and F&F.

now after 22 days leaving company they send one letter to my home that i am absence in company from last 22 days advise with wiriting or we will take legal action against you.

So i request you kindly please advise what to do in such case. Can i file legal notice against company that i need my salary and i had done everything as per rules.

What i have one concern is that if you read my appointment letter then is mentioned that 7 days notice period is required and also mentioned that resignation would become effective only from date of acceptance thereof.

So they are fight with me according to above sentence.\

I think it is not right because if employer will not accept my resignation till next 6 months so it is not necessary that i need to work over there..!!

Kindly advise what to do now..?

An employee who does not collect his Appointment letter, joins duty only for 4 days (probably to have a feel of the job) & disappears thereafter had apparently not been serious about this job. Such an employee would never be interested in any salary or experience letter from your organization.
If by any chance this employee asks for his salary, please request him to send a photo copy of his Appointment letter through his present employer. Please ignore his resignation letter since you have nothing on record of his having accepted the appointment & its terms and conditions. And unless he has accepted the appointment, he can't be on your rolls.
Though it is highly undesirable for an employee to behave in this manner, but the fact remains that employment ethics are not followed by many individuals. Therefore, to avoid heart burns, HR has to ignore such cases and concentrate on retaining those who are contributing to the organization with their dedication & performance.

Dear Member,
Since he has not collected his offer letter, therefore, he doesnt stand liable for any misconduct case in your organization though he had submitted his documents.
You shall not release his salary and update his record in your database and cautious of his application in future and cascade the same thing to the respective teams in your organization.
