Want to discuss a case regarding full & final settlement:
One of my friend who was working as Area sales manager in MNC compnay left the job in the month of Dec 13 due to the closure of the business in India. As the business got shut down, comapny gave one months notice to everyone & promised to give settlement within a month.
The business head is arguing to release the full & final settlement payment saying there is some payment pending from his distributor's end . Until unless we receive the full payment from distributor we will not relase the payment.
My question is when the business head was aware the payment is pending from distributor's end, he should have not asked the employee to leave the job.
Here the company decided to back out , then why an employee is suffering. Today also when my friend called his ex business head, very rudly he disconnected his call saying do not waste my time. The payment will be released post the money receive from distributor.
I am surprised his reginoal manager's full & final payment got released & his settlement is pending. Like him, there were 3-4 ASM, whose payments from distributor's end was pending, got the payment on time.
In this case, we need your help. Pls suggest.
