Overtime limit is mentioned under Factories Act & Shop Act as the case may be depends on applicability. Regards
Dear all
The appropriate Government may fix minimum wages for any employment listed in the schedule to the Minimum Wages Act. It is not as though all the employments listed in the Schedule to the Minimum Wages Act are covered by the Factories Act or the Shops and Commercial Establishments Act, or the Mines Act or the Plantation Labour Act or the Motor Transport Workers Act etc., In the schedule to the Act there are several employments to which any of the laws relating to working conditions is not applicable. One example will be employment in potteries included in the schedule by the Government of Bihar employment in toddy tapping included in the schedule by the Government of Pondicherry, employment in sericulture and employment in forestry included in the Schedule by the Government of Tamilnadu. In such cases, section 13 of the Minimum Wages Act gives power to the appropriate Government to fix hours of work for anormal working day and section 14 gives power to the appropriate Government to fix the overtime rate also in respect of such employment. The normal hours of work for a day and the overtime rate will be indicated in the notification fixing the minimum wages.
